Earnest Money and Escrow- Real Estate Vocabulary Lesson

/ˈərnəst ˈmənē/ and /ˈeskrō/  Earnest money is the cash (usually a personal check) that is paid to the seller by the buyer upon acceptance of a contract to buy a home. The purpose is to provide a good-faith guarantee of the buyer’s seriousness about purchasing the home. Think of it kind of like a deposit.

The amount can vary, but I usually suggest about 1% of the sales price of the home. The check is deposited into the account of a third party (an escrow account) and held until closing day when it is applied to the down payment or closing costs.

When you hear people say that they are “in escrow,” it simply means that they have a contract to buy a home and that they have solidified the contract with a bit of cash to back it up.

What if something happens and the buyer can’t or won’t purchase the home?  Is earnest money always refundable? The answer is… yes and no. Depending on the wording of the contract (READ YOUR CONTRACTS!) earnest money is typically refundable if an inspector finds major defects in the home that the seller refuses to correct or if the buyer can’t obtain financing. If a buyer simply gets cold feet and changes their mind, earnest money is often not refundable. This makes it very important to be sure before signing a contract. It is not always easy to wiggle out later. This protects the seller by compensating them for lost time on the market.

First Time Home Buying in Real Time

alt=”How do I buy a house in Indianapolis"“How do I buy a house?” is one of the most-asked questions that I get. I thought it would help to take my readers through a first-time home buyer’s transaction from start to finish. Here we go!

Part 1:  My clients navigated financing and made an offer on a home they love on the Northeast side of Indy after a thorough second showing, carefully crafting the terms and deciding what fixtures and requirements to include in the offer. That included all of us sloshing through a rain-soaked yard measuring the distance between the septic tank and the well in order to make sure we were in compliance with FHA lending requirements! The offer was accepted after minimal negotiation. My clients delivered the escrow money to the seller’s agent’s office.

Part 2: Inspection was successful.  We had an outstanding professional check for wood destroying insectsseptic compliance, and water quality along with all of the other usual inspection items.

I teach my clients to focus on 3S: Safety, structure, and sanitation.  This makes the inspection more of an educational activity, especially for first-time buyers and ESPECIALLY if they work with responsible inspectors.  They learn what red flags to look for in the future and what items are important to address right away.  I am always with my buyers at inspections so that I can learn along with them and get the information I need to lead them toward the proper inspection response, which is the buyers’ requests for repair and remediation after the purchase agreement is signed.  We are crafting the inspection response now pending the results of the water quality test!

Part 3: We negotiated the repair of a few items in the house. The sellers agreed to fix some things and declined to fix others. It is a give and take process and both parties were fair and cordial. That always makes the process easier.

My buyers found a great insurance company and have officially applied for their loan.  They chose a local lender who knows the area and will be available to both them and me for updates, questions, and concerns.

Part 4: The appraisal went well. The independent appraiser for FHA determined that the house is worth as much or more than the loan that my clients are taking out. If the appraisal had come in low, we would have had several options. We could appeal the appraisal with proof of other homes in the area with similar features that sold for the higher price OR we could have negotiated with the seller to lower the price to meet the appraiser’s valuation. You can’t get a mortgage for more than the house is worth.

Part 5: The buyers’ mortgage has made it through all of the twists and turns of approval and we got a “Clear to Close” notice. That means that we just need to review the closing disclosure to make sure all of the numbers are correct. They are, so we are ready to close!

Part 6: We just closed on the house. My clients brought their IDs and a certified check to the title company for their down payment and closing costs. They signed their names on tons of forms and at the end, I was able to hand them the keys to their first home. I’m so happy for them!

We are also thrilled to be close to historic Highland Park.  It boasts playgrounds, REAL HILLS for workouts, and hands-down, the best sunset views in the whole city!

The housing market in Holy Cross is tight.  We don’t have much on the market right now.  Due to high demand and low inventory, I expect these townhomes to fly off the market.  I’m actively seeking more listings and confident about great returns on your investment.  You might be surprised at what your home will command in this seller’s market.

Holy Cross is a well-kept secret.  All of the perks of Downtown, Old Northside, or Fountain Square without the price tag!  Recent comparable properties are selling from between $170K to $300K with all price points in between.  There really is something for everyone and plenty of potential for investment.

Riverside Neighborhood Guide- Indianapolis

Riverside Neighborhood!

I’m having such a good time learning about this week’s neighborhood, Riverside. I’m excited about the opportunities for both buying and selling in this revitalizing community on the Near Northwest side of Indy.

Riverside is mostly residential, but there are still plenty of neighborhood amenities in the area. The city’s oldest golf course- Riverside Golf Course along with Coffin Golf Course and South Grove Golf Course dominate the west end of the area. Riverside Park is a wonderful place to spend a day. They have a pool, a gym, a boat launch, playgrounds, and sports fields.

The housing market in Riverside is evolving. There aren’t many homes on the market right now and they are priced between about $20,000 for a fixer-upper to $99,900 for a rehabbed 4 bedroom bungalow. The neighborhood is part of the Northwest Area Quality of Life Plan to help revitalize the community. They are working hard to aid the upward trajectory. Responsible investors will find good return on investment if they choose to buy a property to rent to tenants.

Riverside is less than 4 miles from Downtown Indianapolis and all of the great shops, restaurants, and nightlife but you can still have a quaint neighborhood feeling along the river!

This week, I’m hosting an Open House in Avon, just west of Indianapolis, IN. Spurred by recent growth, Avon is expanding. The city maintains close proximity to I-465 and I-70 for downtown commuters but keeps a small-town feel.

Avon City Hall Park is an 82.5 acre park with trails, a lake, and playgrounds. Local restaurants include Charbonos, a local steak and pasta eatery, GreenLeaf, a Vietnamese place featuring Bubble Tea, and FrostBite, an ice cream walk-up. There is even a summertime Farmers Market!

 

The housing market in Avon mirrors the overall market in Central Indiana. Homes are moving quickly- many are selling in as little as one month. Potential buyers should act quickly and come to the table with a strong offer. Potential sellers should take advantage of low inventory and get their home out there in this hot market.  New construction is a great option as many builders are developing new subdivisions.

This week, I’m exploring homes in Westfield, just north of Indianapolis and Carmel, IN. The downtown area, old farmhouses, new construction, a sports park, and city parks and trails combine to give the city a fun, vibrant atmosphere that enticed CNN Money Magazine to place it among their “Best Places to Live” list. The city has a great small-town vibe but it is still only about 35 minutes to downtown Indy.

Much like Zionsville, Westfield is best known for the downtown village with restaurants and shops.Rail Epicurian Market boasts “Food Raised in a Barn” and The Italian House offers a finer dining experience.

 

The housing market in Westfield mirrors the overall market in Central Indiana. Homes are moving quickly- many are selling in as little as one month. All Around Indy for Investors

This week, I’m showing homes in Zionsville, just northeast of Indianapolis, IN. With an established downtown village, quaint neighborhoods, and new construction of homes and townhomes, Zionsville continues to be a hot market. Where Is @RealtyAmanda This Week? Irvington!

Irvington!

This week I am showing homes in the Historic Irvington neighborhood on the east side of Indianapolis. Irvington is a popular neighborhood due to proximity to downtown, interstates, and shopsand restaurants.  Black Acre Brewing and Jockamo Pizza are two of my favorites!

Irvington is also extremely walk-able and bike-able boasting the Pleasant Run Trail, seven miles stretching from Ellenberger Park to Garfield Park.
